• 2.5 Additional Services: Educational content and study materials; Training and workshop programs; Franchise and partnership opportunities; Custom enterprise solutions.
• 2.6 Each product may have specific features, pricing structures, and additional terms which are incorporated by reference into these Terms and communicated at the point of service access.

3. Acceptance of Terms

• 3.1 By creating an account, accessing our platforms, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
• 3.2 These Terms constitute a legally binding agreement between you and Educerns Technologies Pvt. Ltd.

4. Eligibility & Account Requirements

  • Attempt unauthorized access to our systems, networks, or other users' accounts.
  • Upload, share, or distribute harmful, illegal, defamatory, or infringing content.
  • Use automated systems, bots, or scripts to access our services.
  • Interfere with or disrupt the proper functioning of our platforms.
  • Create multiple accounts to circumvent restrictions or limitations.
  • Violate intellectual property rights of Educerns or third parties.
  • Engage in any activity that could harm minors.
• 5.3 Content Standards
  • All user-generated content must be appropriate, respectful, and lawful.
  • Users must not submit content that is offensive, discriminatory, or harassing.

  • Users grant Educerns a license to use submitted content for platform operations.

6. Payments & Subscriptions

  • Certain Educerns products require payment (EduTax Simulator subscriptions, EduSkill examinations, EduPrint orders, etc.).
  • All fees and charges are clearly displayed before purchase.
  • Payments are processed through secure, third-party payment gateways.
• 6.2 Pricing & Payment Terms
  • Prices are subject to change at our discretion with reasonable advance notice.
  • All payments are subject to applicable taxes and fees.
  • Payment must be completed before service activation unless otherwise specified.
  • Failed payments may result in service suspension.
• 6.3 Refunds & Cancellations

7. Intellectual Property Rights

  • Users must not rely on simulator data for real tax compliance.
  • Access is subscription-based with defined validity periods.
• 9.2 EduSkill Certify
  • Certificates are issued based on successful completion of assessments.
  • Certification validity periods and recognition are defined by Educerns.
  • Fraudulent exam practices will result in certificate cancellation.
  • Identity verification may be required for high-stakes certifications.
• 9.3 EduRecruit Hub
  • Job placements and employment outcomes are not guaranteed.
  • Educerns acts as a platform facilitator and is not liable for employer-employee disputes.
  • Users must comply with recruitment platform guidelines.
  • Background verification may be required for certain positions.
• 9.4 EduSage Clinic
  • Business solutions and consulting services are advisory in nature.
  • Educerns is not responsible for third-party vendor performance or outcomes.
  • Custom solutions are subject to separate service agreements.
  • Results and success metrics depend on client implementation.
• 9.5 EduPrint Solutions
  • Orders are subject to product availability and technical specifications.
  • Print quality standards and delivery timelines are communicated at purchase.
  • Custom orders may have different terms and longer processing times.
  • Returns and exchanges are governed by product-specific policies.

10. Service Availability & Performance

• 10.1 Service Levels
  • We strive to provide reliable, uninterrupted service but cannot guarantee 100% uptime.
  • Scheduled maintenance will be communicated in advance when possible.
  • Service interruptions due to circumstances beyond our control are not covered by service guarantees.
• 10.2 Technical Requirements
  • Users are responsible for meeting minimum technical requirements for service access.
  • We may update technical requirements with reasonable notice.
  • Compatibility with all devices and software configurations is not guaranteed.

11. Limitation of Liability

• 11.1 Disclaimer of Warranties

  • These limitations apply regardless of the legal theory under which damages are claimed.

  • Educational outcomes, job placements, and business results depend on individual effort and circumstances.
  • Users must verify important information independently.

12. Indemnification

• You agree to indemnify, defend, and hold harmless Educerns Technologies Pvt. Ltd., its affiliates, officers, directors, employees, and agents from any claims, damages, losses, costs, or expenses arising from:
• Your use or misuse of our services.
• Your violation of these Terms or applicable laws.
• Your infringement of third-party rights.
• Any content or information you submit through our platforms.

13. Termination

• 13.1 Termination by Educerns: We reserve the right to suspend or terminate user accounts if:
  • Users violate these Terms or applicable laws
  • Fraudulent or unlawful activity is detected
  • Misuse of Educerns services occurs
  • Account remains inactive for extended periods
  • Payment obligations are not met
• 13.2 Termination by User: Users may terminate their accounts at any time by contacting our support team. Termination does not relieve users of payment obligations for services already rendered. Certain data may be retained as required by law or legitimate business purposes.
• 13.3 Effect of Termination: Upon termination, user access to services will cease immediately. Provisions that by their nature should survive termination will remain in effect. Termination does not affect accrued rights and obligations.

14. Force Majeure

Educerns shall not be liable for delays or failures in performance caused by events beyond our reasonable control, including but not limited to:

• 13.1 Termination by Educerns: We reserve the right to suspend or terminate user accounts if:
  • Natural disasters and acts of God
  • Fraudulent or unlawful activity is detected
  • Government actions and regulatory changes
  • Pandemic situations and public health emergencies
  • System failures and cyber attacks
  • Labor disputes and supply chain disruptions

15. Dispute Resolution

• 15.1 Internal Resolution:Users are encouraged to first contact our support team to resolve disputes amicably. We will make good faith efforts to address concerns through direct communication. Most issues can be resolved through our customer service processes
• 15.2 Formal Dispute Resolution:If informal resolution is not possible, disputes may be subject to mediation Arbitration proceedings will be conducted under the Indian Arbitration and Conciliation Act, 2015 Both parties retain the right to seek injunctive relief in appropriate circumstances

16. Governing Law & Jurisdiction

• 16.1 Applicable Law: These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
• 16.2 Jurisdiction:Any disputes arising from these Terms or use of our services shall be subject to the exclusive jurisdiction of the courts in India.
• 16.3 Severability:If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Modifications & Updates

• 17.1 Right to Modify:Educerns may revise these Terms from time to time to reflect changes in law, regulation, or business practices Material changes will be communicated to users via email or platform notifications Updated Terms will be posted on our website with the revision date
• 17.2 Acceptance of Changes: Continued use of our services after notification of changes constitutes acceptance of updated Terms If you disagree with changes, you must discontinue use of our services Users will have reasonable notice period to review significant changes

18. Miscellaneous

• 18.1 Entire Agreement: These Terms, together with our Privacy Policy and any product-specific terms, constitute the entire agreement between you and Educerns regarding our services.
• 18.2 Assignment: Educerns may assign these Terms or any rights hereunder without prior notice Users may not assign their rights or obligations without our written consent Any attempted unauthorized assignment will be null and void
• 18.3 Waiver: No waiver of any provision of these Terms shall be deemed a continuing waiver of such provision or any other provision.
• 18.4 Headings:Section headings are for convenience only and do not affect the interpretation of these Terms.
